This policy applies to all Personal Information and data collected in connection with our technology-enabled platforms, websites, mobile applications (Apps), and related services (collectively, the “Diamond Kinetics & SidelineHD Services”).

The Diamond Kinetics & SidelineHD Services Covered by This Policy Include:

  • Diamond Kinetics websites and mobile applications.
  • SidelineHD websites and mobile applications.
  • All related online features, including live streaming, video clips, in-app messaging, and forums.

If you do not agree with this policy, please do not use our Services. By accessing or using the Services, you agree to this Privacy Policy and our Combined Terms of Use.

1. Information You Provide Directly (Personal Information)

This is data you provide when you register, purchase a subscription, or use the Services. It may include:

  • Contact & Identity: Name, email address, mailing address, telephone number, gender, birthdate, password.
  • Financial: Payment-related information provided during transactions (processed by third-party payment processors).
  • Performance & Athletic Data: Performance scores/ratings (e.g., throwing velocity), affiliated sports team names, jersey numbers, academic info (grade level, GPA), and data collected through connected sensors or devices.
  • User Content: Any content, photos, audio, or video you upload, post, or share on the Services.
  • Correspondence: Records of emails and communications if you contact us.

2. Information from Third Parties

We may collect information about you from external sources, including:

  • Scoring & Sensors: Third-party scoring systems (e.g., iScore), sensors (e.g., velocity measurement, fitness monitors), and data from connected social media sites.
  • Non-User Information: If you provide information about another individual (a "Non-User"), you confirm you have their consent (or the consent of their parent/guardian) to share that Personal Information with us.
  • Non-User Consent. You represent and warrant that for all User Content (including but not limited to livestreams of youth sports events) that includes information about any individuals, players, organizations, or teams (each a "Non-User"), you have received express written consent from all Non-Users (or their parent/legal guardian if under 18) to include that information.

3. Information Collected Automatically

When you interact with the Services, we automatically collect data about your activity, equipment, and usage patterns:

  • Usage Details: Traffic data, logs, access details, and how you interact with content.
  • Device Information: IP address, device type, operating system, browser type, and unique device identifiers.
  • Location Information: If you grant permission, we may collect your device's location data.
  • Tracking Technologies: We use cookies, web beacons, and similar technologies to remember your preferences, track usage, and provide personalized services and advertising.

III. HOW WE USE YOUR INFORMATION

We use the collected information for purposes that are necessary for providing the Services and supporting our business:

IV. SHARING YOUR INFORMATION

We may disclose Personal Information to the following parties:

  • Affiliates & Service Providers: To our subsidiaries, affiliates, and trusted third-party contractors who provide services on our behalf (e.g., payment processing, web hosting, marketing).
  • Business Transfers: To a buyer or successor in the event of a merger, acquisition, restructuring, or other transfer of assets.
  • Sports Organizations & Partners: To third parties that you may participate in or have the option to provide information to, such as Major League Baseball (MLB), governing bodies, leagues, clubs, and other specific partners (e.g., USA Baseball, Sports Recruits).
  • Other Users: To other users and public platforms (like Facebook and YouTube) as necessary to facilitate the permitted sharing and viewing of User Content (e.g., live streaming).
  • Legal Compliance & Safety: To comply with any court order, law, or legal process, or if we believe disclosure is necessary to protect the rights, property, or safety of Diamond Kinetics, our customers, or others.

Note on Text Messaging Data: We will not share your telephone number or text messaging originator consent for third-party direct marketing purposes.

V. CHILDREN UNDER THE AGE OF 13 AND MINORS

The Services are not directed toward children under the age of 13 without the consent of a legal guardian.

  • Under 13: We do not knowingly collect Personal Information from children under 13 without express parental consent. If we learn we have collected such information, we will delete it.
  • Minors (Ages 13-18): As set forth in our Terms of Use, users under the age of 18 are subject to the supervision and consent of a parent or legal guardian (the Account Holder). If you, as a parent or guardian, provide us with a child's Personal Information, you expressly consent to our use of that information as described in this policy.

If you believe we have unauthorized information about a child under 13, please contact us immediately.

VI. YOUR PRIVACY RIGHTS AND CHOICES

You have choices regarding how your information is used:

  • Tracking Technologies: You can set your browser to refuse cookies, though some parts of the Services may not function properly if you do.

    • Note that deleting Personal Information usually requires deleting your entire user account. We may retain certain information as required or permitted by law (e.g., for tax records or to maintain an active transaction history).
  • State Privacy Rights (e.g., California, Virginia): Residents of certain US states may have additional rights, including the right to opt-out of the "selling" or "sharing" of Personal Information (used for targeted advertising). We endeavor to honor Global Privacy Control (GPC) signals and provide mechanisms within your account profile for these requests.

We use generally accepted security measures, including firewalls and secure operating environments, to protect your Personal Information. However, no data transmission over the internet is 100% secure. Any transmission of Personal Information is at your own risk.

The Services are controlled from the United States. We will handle your Personal Information in accordance with this policy regardless of where it is stored.
